It must be:<\/p>\n<ul>\n<li>Prepared by a licensed expert (engineer, architect, etc.)<\/li>\n<li>Updated at least once per year<\/li>\n<li>Reviewed every 5 or 10 years depending on building size<\/li>\n<li>Include a detailed 25-year plan for major repairs<\/li>\n<\/ul>\n<p><strong>Deadline to comply: August 14, 2028<\/strong>.\u00a0After this date, a non-compliant or outdated maintenance log may complicate resale or lead to legal risk for the condo board.<\/p>\n<p>\u201cThe <a href=\"https:\/\/genispec.com\/en\/building-expert\/building-maintenance-handbook-for-condominiums\/\">maintenance log<\/a> must be updated by the board of directors at least once a year.\u201d &#8211; Gazette officielle du Qu\u00e9bec, Article 4<\/p>\n<h3>Reserve Fund Study: based on real data, not estimates<\/h3>\n<p>Boards are now required to obtain a <strong>contingency fund study every 5 years<\/strong>.<\/p>\n<p>\u201cA <a href=\"https:\/\/genispec.com\/en\/building-expert\/reserve-fund-study\/\">contingency fund study<\/a> must be obtained by the board of directors at least every five years.\u201d &#8211; Gazette officielle du Qu\u00e9bec, Article 8<\/p>\n<p>This study must reflect:<\/p>\n<ul>\n<li>The actual condition of the building<\/li>\n<li>Planned repairs, their timing, and estimated costs<\/li>\n<li>The current and required balance of the fund<\/li>\n<\/ul>\n<p>The days of vague projections are over. This study must include hard numbers to guide contributions. Like the maintenance log, boards have <strong>until August 14, 2028 to comply<\/strong>.<\/p>\n<h2>Syndicate Certificate: now mandatory for every sale<\/h2>\n<p><strong>As of August 14, 2025<\/strong>, you can\u2019t sell a condo without it. This declaration must include:<\/p>\n<ul>\n<li>Actual balance of the contingency and self-insurance funds<\/li>\n<li>Planned or completed repair work<\/li>\n<li>Any current disputes or insurance claims<\/li>\n<\/ul>\n<p>It must be signed by an authorized representative and based on the most recent maintenance log and fund study.<\/p>\n<h2>Buyer Deposits: now fully protected by law<\/h2>\n<p>As of August 14, 2025, any deposit paid toward the purchase of a condo unit <strong>must be held in a trust account by a licensed professional<\/strong> (lawyer, notary, CPA, or certified administrator).<\/p>\n<p>Developers and promoters can no longer access these funds before delivery. This rule is intended to protect buyers from construction delays, disputes, or project failures.<\/p>\n<h2>Next steps for condo boards<\/h2>\n<p>If you&#8217;re on a board or manage a building, here\u2019s what you need to do now:<\/p>\n<ul>\n<li><strong>Check your logbook<\/strong>: Is it up to date, signed by a professional, and compliant with the new requirements?<\/li>\n<li><strong>Update or order a reserve fund study<\/strong>.
